1. What this event involves

The Construction Games is a timed physical competition built from construction and trade work. It is held outdoors on a working farm, on uneven and unpaved ground, in whatever weather the day brings. Over the course of the event you may be asked to lift, carry, drag, push, stack, shovel, swing, and climb with heavy objects and tools, and to run between stations while fatigued. The specific stations are not published in advance and are announced at the athlete briefing.

2. Assumption of risk

I understand that participating carries real and serious risks, including but not limited to: strains, sprains, torn muscles and tendons, crushed or broken fingers, hands and feet, back and spinal injury, head injury and concussion, cuts, splinters, burns and abrasions, heat illness, hypothermia, dehydration, cardiac events, stroke, permanent disability and death. These risks may arise from my own actions, from the actions of other participants, staff, judges or spectators, from equipment failure, from the condition of the ground, structures, livestock or premises, or from conditions that nobody anticipated.

I knowingly and freely assume all of these risks, both known and unknown, and accept full responsibility for my participation.

3. Fitness and medical representation

I confirm that I am physically fit and sufficiently trained to participate, that no physician or other medical professional has advised me against strenuous physical activity, and that I am not participating against medical advice. I accept sole responsibility for deciding whether I am fit to start and to continue. I will stop and notify event staff if I become injured or unwell.

I consent to emergency medical treatment being administered to me by event medical staff or emergency responders if I am unable to consent at the time, and I accept responsibility for all costs of medical care, ambulance transport and hospitalization arising from my participation.

4. Release and waiver

In consideration of being permitted to participate, I, for myself and for my heirs, executors, administrators and assigns, hereby release, waive, discharge and covenant not to sue The Construction Games, Gregory L. Vetter, the owners and lessees of the premises on which the event is held, and each of their respective officers, employees, contractors, volunteers, judges, medical personnel, sponsors, vendors and agents (together, the "Released Parties") from any and all liability, claims, demands, actions and causes of action arising out of or related to any loss, damage, injury, illness or death that I may suffer in connection with the event, including any such loss caused in whole or in part by the ordinary negligence of the Released Parties.

This release does not apply to gross negligence, recklessness, or intentional or willful misconduct by a Released Party, and does not waive any right that cannot lawfully be waived.

5. Indemnification

I agree to indemnify and hold the Released Parties harmless from any loss, liability, damage, claim or cost, including reasonable attorneys' fees, that they may incur as a result of my participation, my violation of the event rules, or any injury or damage I cause to another person or to property.

6. Rules, judging and conduct

I agree to follow all event rules, movement standards, safety instructions and the directions of judges and staff. I understand that event staff may stop me, disqualify me, or remove me from the course at any time for safety or conduct reasons, and that their decision is final. I will not participate while under the influence of alcohol or any substance that impairs judgment or coordination.

7. Photography and likeness

I grant The Construction Games the irrevocable right to photograph, film and record me at the event, and to use my name, image, voice, likeness, division and results in any media, for promotion of the event and future events, without compensation to me.

8. Entry, transfers and refunds

Entry is personal to me and may not be sold or transferred without written approval from the event. Refund requests should be sent to boss@theconstructiongames.com. The event may be postponed, relocated, shortened or cancelled for weather, ground conditions, safety or circumstances outside its control.

9. Eligibility

I confirm I am at least 18 years old on the day of the event.

10. General

This agreement is governed by the laws of the State of Maryland, without regard to conflict of laws principles, and any action relating to it shall be brought in the state or federal courts located in Anne Arundel County, Maryland. If any part of this agreement is held unenforceable, the remainder stays in full force. This is the entire agreement between me and the event on this subject and supersedes any prior understanding.

I have read this agreement, I understand it, I understand that I am giving up substantial legal rights by agreeing to it, and I am agreeing to it freely and without inducement.
